Terms for the Phase site, app, and connected pillow.

1. Who provides Phase

Phase is built and operated by Future Blue Technologies Inc. (“Phase,” “we,” “us”), a Canadian corporation registered in Quebec, with its registered office at 340 Rue Saint-Louis, Saint-Jean-sur-Richelieu, QC J3B 1Y4, Canada.

2. What these terms cover

These terms cover phasepillow.com, the Phase mobile app, cloud access, firmware updates, support, and connected Phase hardware. Purchases, reservations, refunds, trials, and warranty terms may also be covered by the separate pre-order or checkout terms shown when you buy.

3. Accounts and access

You are responsible for keeping control of the email account used to sign in to Phase. We may send sign-in codes, service notices, support messages, firmware update notices, warranty messages, and security notices to that email address.

We may suspend or limit access if we reasonably believe an account, device, API token, or network path is being used to interfere with the service, compromise another customer, or damage Phase hardware.

4. Connected hardware and remote control

Phase can control fans, temperature targets, pumps, lighting, and firmware on supported hardware. You agree to use the app and hardware only with the supplied Phase components and instructions.

Cloud access depends on power, Wi-Fi, internet service, our cloud providers, and firmware health. We do not guarantee that remote control, telemetry, or firmware updates will be available at every moment.

5. Firmware and software updates

We may provide app updates, firmware updates, configuration updates, and cloud-side changes to improve reliability, safety, security, and product performance. Some updates may be required before a feature, support action, or remote-control path continues to work.

6. Privacy

Our privacy policy explains what we collect, why we collect it, who processes it, and how to make privacy requests. It is available at phasepillow.com/privacy.

7. Acceptable use

You may not:

• reverse engineer, resell, or abuse the cloud service;
• attempt to access another customer’s device or data;
• send malicious commands, malformed payloads, or excessive traffic;
• disable safety mechanisms or operate damaged hardware; or
• use Phase in medical, emergency, or life-safety contexts.

8. No medical advice

Phase is a consumer comfort product. It is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or medical condition.

9. Intellectual property

The Phase name, marks, app, firmware, site, product designs, text, images, and other materials are owned by Future Blue Technologies Inc. or its licensors. We grant you a limited, non-transferable right to use the app and service with your Phase hardware.

10. Disclaimers and limitation of liability

To the maximum extent allowed by law, Phase is provided without guarantees that the app, site, cloud service, or remote-control features will be uninterrupted, error-free, or compatible with every network, phone, or environment.

Nothing in these terms excludes warranties, remedies, or protections that cannot be excluded under applicable consumer protection law.

11. Changes

We may update these terms as the product changes. Material changes will be posted on this page and, where appropriate, sent by email or shown in the app.

12. Governing law and contact

These terms are governed by the laws of Quebec and the federal laws of Canada applicable there, except where consumer law requires otherwise. Questions can be sent to hello@phasepillow.com.
